The user of this website undertakes to comply fully and without exceptions with the terms and conditions of use as stated in the website at the moment of access. If for any reason the user does not accept the terms and conditions, the user may freely cease to use the website. Urban gallery may modify the terms and conditions of use at any time and without previous notice. The user of the website must comply and accept to the terms and conditions of the most recent version of these at the moment of access to the website.

This website is owned and administered by Urban Gallery and acts commercially as an art website. All content in the website is property of Urban gallery and/or the artist, including images, texts, videos, illustrations and computer programs and are protected by copyright laws.  All elements of the website, including and without limitations the general design and its content are protected by copyright and intellectual property laws.

 

USE OF CONTENT

Unless otherwise expressly authorized by Urban Gallery, this site or any portion of it may not be reproduced, transmitted, duplicated, copied, sold, resold or otherwise exploited in any manner. The user must abide to the established terms and conditions, and will be obliged to compensate urban gallery and/or the artist in the event of loss, incurred costs or damages that may arise from the unfulfillment or breach by part of the user of any of the terms and conditions of use with respect to the content of the website unless previously and expressly authorized.

 

APLICABLE LEGISLATION AND JURISDICTION

The terms and conditions of use are subject to spanish legislation and as such should be interpreted. Any dispute arising with respect to the terms and conditions will be settled in courts of Barcelona, Spain. This accord will not be regulated by the united nations convention with regards to contracts for the international sale of merchandise, which is expressly not accepted.

 

CONFIDENTIALITY AND SECURITY GUARANTY

Urban gallery respects your privacy rights and we understand that when you identify yourself as a user of the website you want to preserve the confidentiality and security of the information provided as a user.

With respect to this, we would want to inform you of the following:

-when you register or purchase through the website, you will be required to provide your name, address, e-mail address and telephone number. This information will allow us to deliver your purchase and keep you informed of the situation of your purchase.

-payments services are provided by Paypal and using a safe server. Urban gallery does not register any information with respect to  your credit/debit card. The mentioned server codifies all information regarding you payment cards, which guaranties the confidentiality and security of the credit/debit card.

 

DATA PROTECTION

Urban gallery implements strict security procedures relative to the storing and disclosure of data in order to avoid any unauthorized access to them, according to the spanish law (“artículo 9 DE LA LEY ORGANICA 15/1999”), in relation the protection of personal information.

In compliance with the mentioned law, dated december 13th, in relation to the protection of personal data/information applicable in spain (further referred to as “lopd”), urban gallery informs that by filling the out registration form your personal information will be stored in an electronic data file.

We inform you of your rights, in the terms established in lopd, to access, rectify, cancel or oppose/disagree with the personal data, being urban gallery responsible for this file.

Due to this, Urban gallery guaranties you, in the terms established in article 9 of LOPD, that you personal data will be treated with confidentiality since the files in which the date will be stored and administered implement those security controls necessary to avoid the loss and unauthorized administration or access by third parties.

GENERAL CONDITIONS OF PURCHASE

Any purchases done in Urban gallery are subject to the general conditions of purchase as published in the website at the moment of the sending the purchase order.  Formalizing a purchase order expressly implies the acceptance of the general conditions of purchase.

 

FORMALIZATION OF CONTRACT

Information in the website relative to the availability of artwork is subject to changes without prior notice, depending on client demand and the will of our artists.

When formalizing a purchase order, we will confirm the purchase via e-mail and you will be informed of any changes in the availability of the artwork you wish to purchase. You must read the e-mail and immediately communicate any errors or discrepancies with respect to price, delivery or method of payment.

Urban gallery can, at its discretion, cancel any purchase orders with typographical, mathematical or details which may contain an imprecise delivery address which could make it difficult to deliver the artwork.

Urban gallery respects your right to change your mind. If you wish to cancel a purchase order which has not yet been dispatched, you may do so by sending an e-mail to info@urbangallery.es expressing your intention to cancel the order and detailing the purchase order number you wish to cancel.

 

DELIVERY

Purchases will be delivered in a single dispatch.

Delivery lead time of each article will be subject to the location of delivery, the availability of the artwork and to the method/type of delivery requested.

The cost derived from customs in any international destinations will be paid and settled by the client with the respective customs authorities.

 

FORMS OF PAYMENT

Urban gallery only accepts cash on delivery (further referred to as “cod”) method of payment only for deliveries in Spain and Andorra. Cod will only be accepted in euros and in cash. Neither checks nor any other currency will be accepted.

Urban gallery accepts the following electronic payment by means of credit or debit cards corresponding to the following: 4B, Visa, Mastercard and American express.

The amount of your purchase will be charged to your card at the moment of acceptance by pay pal. If the client requests its bank to cancel a charged amount for a formalized purchase order, the client will be obliged to compensate urban gallery for damages as a consequence of cancelling the charged amount.

 

RETURN OF ARTICLES AND REFUNDS

Urban gallery will accept those returned articles within the specified period (7 days from the reception of the article), conditioned to that the artwork is undamaged.

Once the artwork is again in our possession at our address in Barcelona, Urban gallery will proceed to examine the article to verify it has no damages before proceeding to refund the amount paid for the artwork.

 

TAXES

Urban gallery applies any and all taxes as established by valid spanish laws.

 

APLICABLE LAWS AND JURISDICTION

Purchases in urban gallery are subject to valid spanish laws and any other related legislation.

With respect to any discrepancy or disagreement arising from the interpretation of the purchase agreement reached, or any of its terms and conditions, the parts agree that it should be judged by the courts and jurisdictions of Barcelona, Spain.
